    Nik\u00e2h s\u00f6zc\u00fc\u011f\u00fc Arap\u00e7a “nekeha”<\/strong> fiilinden bir mastar olup, erke\u011fin kad\u0131nla evlenmesi ve onunla cinsel temasta bulunmas\u0131 anlam\u0131na gelir. Bu s\u00f6zc\u00fc\u011f\u00fcn “evlilik akdi” anlam\u0131 mecaz, “cinsel temas” anlam\u0131 ise ger\u00e7ek anlamd\u0131r.<\/p>\n

    Bir f\u0131k\u0131h terimi olarak nik\u00e2h; \u015fer’an evlenme engeli bulunmayan bir kad\u0131n\u0131n, cinsel y\u00f6nlerinden yararlanmay\u0131 erke\u011fe m\u00fcbah k\u0131lan riza\u00ee bir akittir. M\u00fcteahh\u0131r\u00fbn (12. M. y\u00fczy\u0131ldan sonraki) fakihlerinin tarifi ise \u015f\u00f6yledir; nik\u00e2h kasten m\u00fclk-i mut’ay\u0131 ifade eden bir akittir.[2] Yani erke\u011fe kad\u0131n\u0131n cinsel y\u00f6nlerinden yararlanma m\u00fclkiyeti hakk\u0131 veren bir s\u00f6zle\u015fmedir. Evlilik, nitelikleri dikkate al\u0131narak a\u015fa\u011f\u0131daki \u015fekilde tarif edilebilir: Evlenmeleri yasak olmayan bir erkekle bir kad\u0131n aras\u0131nda yap\u0131lan, birbirinin cinsel y\u00f6nlerinden yararlanmay\u0131 me\u015fru k\u0131lan, ortak hayat ve nesli s\u00fcrd\u00fcrmek i\u00e7in bir ba\u011f meydana getiren akittir. \u0130sl\u00e2m’da nik\u00e2h akdi hem meden\u00ee bir mu\u00e2mele ve hem de bir ibadettir. \u00c7\u00fcnk\u00fc nik\u00e2h\u0131n r\u00fck\u00fcn ve \u015fartlar\u0131n\u0131 \u0130sl\u00e2m belirler ve e\u015flerin evlilik nedeniyle pek b\u00fcy\u00fck ecirlere ula\u015faca\u011f\u0131n\u0131 haber verir. Evlili\u011fin niteli\u011fini \u0130bn\u00fc’l-H\u00fcm\u00e2m (\u00f6. 861\/1457) \u015f\u00f6yle belirtir: “Nik\u00e2h ibadetlere daha yak\u0131nd\u0131r. Hatta evlenmek, s\u0131rf ibadet niyetiyle bek\u00e2r kalmaktan daha \u00fcst\u00fcnd\u00fcr.”[3] Son devir fakihlerinden \u0130bn \u00c2bid\u00een (\u00f6. 1252\/1836) \u00fcnl\u00fc Redd\u00fc’l-Muhtar adl\u0131 eserinde nik\u00e2h konusuna \u015fu c\u00fcmlelerle ba\u015flar: “Bizim i\u00e7in Hz. Adem devrinden g\u00fcn\u00fcm\u00fcze kadar me\u015fru olmu\u015f, sonra cennette de devam edecek, nik\u00e2h ile imandan ba\u015fka ibadet yoktur.”[4]\n

    Nik\u00e2h\u0131n mescid i\u00e7inde akdedilmesi ve uygun olursa cuma g\u00fcn\u00fcne rastlat\u0131lmas\u0131 m\u00fcstehapt\u0131r. Bu durum da onun ibadet y\u00f6n\u00fcn\u00fc g\u00fc\u00e7lendirir.[5]\n

    \u015e\u00e2fi\u00eelere g\u00f6re evlilik, al\u0131\u015f-veri\u015f gibi d\u00fcnyaya ait alel\u00e2de i\u015flerden olup, ibadet niteli\u011finde de\u011fildir. Dayand\u0131klar\u0131 delil, gayrim\u00fcslimlerin nik\u00e2h\u0131n\u0131n da \u0130sl\u00e2m nazar\u0131nda ge\u00e7erli say\u0131lmas\u0131d\u0131r. E\u011fer ibadet olsayd\u0131, onlar\u0131n nik\u00e2hlar\u0131n\u0131n ge\u00e7ersiz olmas\u0131 gerekirdi. Evlilikten gaye, ki\u015finin cinsel isteklerini teskinden ibarettir. \u0130badet ise y\u00fcce Allah i\u00e7in bir i\u015f ve bir amel yapmakt\u0131r. Bu y\u00fczden Allah i\u00e7in i\u015f yapmak kendi nefsi i\u00e7in i\u015f yapmaktan daha faziletlidir. \u015e\u00e2fi\u00eelerin bu g\u00f6r\u00fc\u015f\u00fcne \u00e7o\u011funluk mezhep m\u00fcctehitleri kar\u015f\u0131 \u00e7\u0131km\u0131\u015ft\u0131r. \u015e\u00f6yle ki:<\/p>\n

    \u00c7o\u011funluk m\u00fcctehitlere g\u00f6re evlilik akdinin m\u00fcslim veya gayrim\u00fcslim i\u00e7in ge\u00e7erli olmas\u0131 d\u00fcnyada toplum d\u00fczeni ile ilgilidir. Nitekim mescit, yol yap\u0131m\u0131 ve benzeri hay\u0131r i\u015fleri M\u00fcsl\u00fcman i\u00e7in bir ibadet oldu\u011fu halde, gayrim\u00fcslim i\u00e7in bir ibadet say\u0131lmaz. Genel anlamda Allah Te\u00e2l\u00e2’n\u0131n ho\u015fnut ve raz\u0131 oldu\u011fu her i\u015f ve davran\u0131\u015f m\u00fc’min i\u00e7in bir ibadettir. Bu y\u00fczden \u0130sl\u00e2m’\u0131n belirledi\u011fi esaslara g\u00f6re kurulan ve buna g\u00f6re y\u00fcr\u00fct\u00fclen evlilik de ibadet niteli\u011findedir. \u00c7\u00fcnk\u00fc evlenmekle, nefsi haramlardan korumak ve nesli s\u00fcrd\u00fcrmek gibi bir \u00e7ok toplum maslahatlar\u0131 ger\u00e7ekle\u015fir. Nitekim Hz. Peygamber \u015f\u00f6yle buyurmu\u015ftur:<\/p>\n

    Sizden birinizin evlili\u011finde sadaka sevab\u0131 vard\u0131r.”[6] “Bir kimsenin sarf edece\u011fi en faziletli para (dinar), kendi aile fertlerine harcayaca\u011f\u0131 para ile, Allah yolunda hayvan\u0131na ve yine Allah yolunda cihad edecek olan arkada\u015flar\u0131na harcayaca\u011f\u0131 parad\u0131r.”[7] “\u00c7ocuklar\u0131na, e\u015fine ve hizmet\u00e7ine yedirdi\u011fin senin i\u00e7in bir sadakad\u0131r.”[8]\n

     <\/p>\n

    Di\u011fer yandan kocalar\u0131 yoksul olan iki varl\u0131kl\u0131 kad\u0131n, Allah’\u0131n el\u00e7isine gelerek, kocalar\u0131na sadaka verip veremeyeceklerini sormu\u015flard\u0131. Hz. Peygamber onlara \u015fu cevab\u0131 verdi: “Kocalar\u0131n\u0131za yard\u0131m ederseniz size iki ecir vard\u0131r. H\u0131s\u0131ml\u0131k ecri ve sadaka ecri.”[9]\n

    Bat\u0131 \u00fclkeleri Hristiyan toplumlar\u0131nda nik\u00e2h\u0131n din\u00ee veya medeni niteli\u011fi uzun s\u00fcre tart\u0131\u015f\u0131lm\u0131\u015f, kimi \u00fclkelerde nik\u00e2h yaln\u0131z kiliselerde akdedilirken, kimi \u00fclkelerde de medeni nik\u00e2h esas\u0131 benimsenmi\u015ftir. Resmi devlet memuru \u00f6n\u00fcnde akdedilen nik\u00e2ha “meden\u00ee nik\u00e2h” denir.<\/p>\n

    Osmanl\u0131 Devleti uygulamas\u0131nda 1917 tarihli “Hukuk-\u0131 Aile Kararnamesi” Hristiyan veya Musev\u00eeler i\u00e7in k\u0131smen din\u00ee ve k\u0131smen de meden\u00ee evlenme usul\u00fc getirmi\u015ftir. Buna g\u00f6re gayrim\u00fcslimlerin nik\u00e2h\u0131, din\u00ee ayinler \u00e7er\u00e7evesinde r\u00fbhan\u00ee memurlar\u0131nca yani papaz veya rahiplerce akdedilir. Ancak ruhan\u00ee memur, en az yirmi d\u00f6rt saat \u00f6nce mahall\u00ee mahkemeye haber verir. Hakim; belirtilen saatte nik\u00e2h meclisine \u00f6zel bir memur g\u00f6nderip k\u0131y\u0131lan nik\u00e2h\u0131 deftere kay\u0131t ve tescil ettirir.[10] Ad\u0131 ge\u00e7en kararnameye g\u00f6re, M\u00fcsl\u00fcmanlar\u0131n evlili\u011fi de, ayn\u0131 \u015fekilde evde, bir salon veya mescidde, hakim naibinin haz\u0131r bulundu\u011fu bir mecliste akdedilece\u011fi esas\u0131 getirilmi\u015ftir. B\u00f6ylece, ayr\u0131 dinlere mensup topluluklara, kendi inan\u00e7lar\u0131na uygun bir \u015fekilde evlenme, bo\u015fanma, nafaka, miras ve ticaret yapma serbestli\u011fi tan\u0131nm\u0131\u015ft\u0131r.<\/p>\n

      Ayette M\u00fcsl\u00fcmanlar\u0131n, yoksul olsalar bile bek\u00e2r olan erkek ve kad\u0131nlar\u0131 evlendirmeleri, \u00e7\u00fcnk\u00fc Allah\u2019\u0131n onlara evlilik sebebiyle yard\u0131mc\u0131 olaca\u011f\u0131 bildirilmektedir.<\/p>\n

      Evlenmek: Yukar\u0131daki ayette, \u201cevlendiriniz\u201d ifadesi, evlilik konusunda e\u015fler kadar, veli veya \u0130sl\u00e2m toplumuna da g\u00f6rev d\u00fc\u015ft\u00fc\u011f\u00fcn\u00fc g\u00f6sterir.<\/p>\n

Sizden kimin evlilik y\u00fck\u00fcml\u00fcl\u00fcklerine g\u00fcc\u00fc yeterse evlensin. \u00c7\u00fcnk\u00fc evlilik g\u00f6z\u00fc ve \u0131rz\u0131 harama kar\u015f\u0131 koruyucudur: Kimin evlenmeye g\u00fcc\u00fc yetmezse oruca devam etsin. \u00c7\u00fcnk\u00fc oru\u00e7 onun i\u00e7in bir kalkand\u0131r.”[12]\n

      “Baz\u0131 kimselere ne oluyor ki, \u015f\u00f6yle \u015f\u00f6yle demi\u015fler. Fakat ben hem namaz k\u0131l\u0131yorum, hem uyuyorum; oru\u00e7 tutuyorum, tutmad\u0131\u011f\u0131m da oluyor; kad\u0131nlarla da evleniyorum. Kim benim s\u00fcnnetimi terk ederse benden de\u011fildir.”[13]\n

      Hz. \u00c2i\u015fe’nin nakletti\u011fi bir hadiste \u015f\u00f6yle buyurulmu\u015ftur:<\/p>\n

      “Nik\u00e2h benim s\u00fcnnetimdir. Kim benim s\u00fcnnetimden y\u00fcz \u00e7evirirse, benden de\u011fildir.”[14]\n

      Di\u011fer yandan evlenmenin me\u015frulu\u011fu \u00fczerinde, b\u00fct\u00fcn \u00fcmmet g\u00f6r\u00fc\u015f birli\u011fi i\u00e7indedir. Ancak evlenmenin h\u00fckm\u00fc evlenecek ki\u015finin \u00f6zel durumu dikkate al\u0131narak de\u011ferlendirilir. A\u015fa\u011f\u0131da \u00e7e\u015fitli durumlara g\u00f6re konuyu a\u00e7\u0131klayaca\u011f\u0131z.<\/p>\n

      1. C) Evlenmenin H\u00fckm\u00fc:<\/strong><\/li>\n<\/ol>\n

        Evleneceklerin durumuna g\u00f6re nik\u00e2h\u0131n h\u00fckm\u00fc farz, vacip, s\u00fcnnet, haram, mekruh veya m\u00fcbah k\u0131s\u0131mlar\u0131na ayr\u0131l\u0131r.<\/p>\n

        Evlenmedi\u011fi takdirde zinaya d\u00fc\u015fece\u011fi kesin olan kimsenin evlenmesi farzd\u0131r.<\/p>\n

        Yine evlenmezse zinaya d\u00fc\u015fme tehlikesi bulunan kimsenin evlenmesi vaciptir.[15]\n

        Evlenince, e\u015fine zul\u00fcm ve i\u015fkence yapaca\u011f\u0131 kesin olan kimsenin evlenmesi haramd\u0131r.<\/p>\n

        E\u015fine zul\u00fcm yapma ihtimali bulunan kimsenin evlenmesi mekruhtur.[16]\n

        Cinsel bak\u0131mdan itidal halde bulunanlar\u0131n evlenmesi s\u00fcnnettir.<\/p>\n

        \u0130mam \u015e\u00e2fi\u00ee’ye g\u00f6re yukar\u0131da belirtti\u011fimiz itidal durumunda evlenmek m\u00fcbah olup, m\u00fc’min evlenme veya evlenmeme aras\u0131nda serbest b\u0131rak\u0131l\u0131r. Dayand\u0131\u011f\u0131 delil; Yahy\u00e2 Peygamber\u2019in “…efendi, nefsine h\u00e2kim ve iffetli.”[17] oldu\u011fu belirtilerek buyrularak \u00f6v\u00fclmesi ve \u201csize evlilik helal k\u0131l\u0131nd\u0131.\u201d[18] ayetiyle \u201cm\u00fcbah k\u0131l\u0131nma\u201d n\u0131n ifade edilmesidir.<\/p>\n

        1. D) Nik\u00e2h\u0131n R\u00fck\u00fcnleri:<\/strong><\/li>\n<\/ol>\n

          Hanef\u00eelere g\u00f6re, evlilik akdinin r\u00fck\u00fcnleri icap ve kabulden ibarettir. \u00c7o\u011funluk mezhep imamlar\u0131na g\u00f6re ise evlili\u011fin r\u00fck\u00fcnleri d\u00f6rt tane olup; siyga (icap ve kabul), kad\u0131n, koca ve evlenecek kad\u0131n\u0131n velisidir.<\/p>\n

          Evlilik akdinin konusu, yani e\u015flerin bu evlilikten gayeleri, birbirinin cinsel y\u00f6nlerinden yararlanmad\u0131r. Bu y\u00fczden yaln\u0131z ev hizmetlerini g\u00f6rmek \u00fczere yap\u0131lacak bir akit bir “i\u015f s\u00f6zle\u015fmesi” olabilir. Nik\u00e2h akdinde kar\u0131 koca hayat\u0131n\u0131n ya\u015fanmas\u0131 as\u0131ld\u0131r. Mehir, evlili\u011fin kendisine ba\u011fl\u0131 oldu\u011fu bir r\u00fck\u00fcn de\u011fil; nafaka gibi evlili\u011fin h\u00fck\u00fcmlerindendir.<\/p>\n

          \u0130cap, evlenme akdi taraflar\u0131ndan birisinin ilk olarak yapt\u0131\u011f\u0131 tekliftir. “Benimle evlenmeyi kabul et” teklifine, kar\u015f\u0131 taraf\u0131n “kabul ettim” \u015feklindeki cevab\u0131 “kabul” niteli\u011findedir. Burada ilk teklifin kar\u0131 veya koca taraf\u0131ndan yap\u0131lmas\u0131 sonucu etkilemez. \u0130lk teklif icap, ikincisi kabul niteli\u011findedir.<\/p>\n

          \u00c7o\u011funluk \u0130sl\u00e2m fakihlerine g\u00f6re icap, kad\u0131n\u0131n velisi veya vekili taraf\u0131ndan erke\u011fe yap\u0131lan evlendirme teklifidir. Kabul ise, kocan\u0131n bu teklife verdi\u011fi olumlu cevapt\u0131r.[19]\n

Akitlerde \u015fahit, genellikle anla\u015fmazl\u0131k durumunda taraflar\u0131n haklar\u0131n\u0131 korumada ispat kolayl\u0131\u011f\u0131 sa\u011flar. Evlenme akdi de e\u015flerin lehine ve aleyhine hukuk\u00ee sonu\u00e7lar meydana getiren bir akittir. Mehir, nafaka y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc, nesebin sabit olmas\u0131, s\u0131hr\u00ee h\u0131s\u0131ml\u0131\u011f\u0131n do\u011fmas\u0131 bunlar aras\u0131ndad\u0131r. Di\u011fer yandan evlilik akdinin topluma il\u00e2n edilerek yap\u0131lmas\u0131 ve \u015fahitlerin bulunmas\u0131 evlileri zina t\u00f6hmetinden korur.<\/p>\n

                D\u0131\u015far\u0131da a\u00e7\u0131klanmamak \u00fczere gizlice yap\u0131lan nik\u00e2h akdi caiz de\u011fildir. Ancak nik\u00e2h akdi \u015fahitlerin \u00f6n\u00fcnde yap\u0131l\u0131p da, sonradan \u015fahitlere bunu gizlemeleri ve d\u0131\u015far\u0131da a\u00e7\u0131klamamalar\u0131 tavsiye edilse, bu evlilik gizli yap\u0131lm\u0131\u015f say\u0131l\u0131r m\u0131?<\/p>\n

                Eb\u00fb Han\u00eefe ve \u0130mam \u015e\u00e2fi\u00ee’ye g\u00f6re b\u00f6yle bir evlilik gizli yap\u0131lm\u0131\u015f say\u0131lmaz. \u00c7\u00fcnk\u00fc \u015fahitlere sonradan yap\u0131lacak gizli tutma tavsiyeleri nik\u00e2h akdine zarar vermez. [29]\n

                \u0130mam M\u00e2lik ise evlili\u011fin topluma il\u00e2n\u0131n\u0131 bir \u015fart olarak kabul etti\u011fi i\u00e7in, gizli yap\u0131lan veya \u015fahitlerden gizlemeleri istenen bir nik\u00e2h\u0131 ge\u00e7erli saymaz.<\/p>\n

                \u0130mam Malik gizli nik\u00e2h\u0131 \u015f\u00f6yle tarif eder: Kocan\u0131n \u015fahitlerden nik\u00e2h akdini, daha \u00f6nce evli ise \u00f6nceki kar\u0131s\u0131ndan veya ev halk\u0131 bile olsa di\u011fer insanlardan gizlemelerini istedi\u011fi nik\u00e2ht\u0131r. B\u00f6yle bir evlilikte cinsel birle\u015fme olmu\u015fsa, \u015fahitsiz evlilikle birle\u015fmede oldu\u011fu gibi nik\u00e2h akdi feshedilir ve bu bir bain talak (kesin bo\u015fama) say\u0131l\u0131r. E\u011fer e\u015fler cinsel birle\u015fmeyi ikrar eder veya bu durum, zinadaki gibi d\u00f6rt \u015fahitle sabit olursa her iki e\u015fe de de\u011fnek (celde) veya recm cezas\u0131 uygulan\u0131r. Ancak def \u00e7almak veya d\u00fc\u011f\u00fcn yeme\u011fi vermek yahut veli d\u0131\u015f\u0131nda tek \u015fahitle de olsa nik\u00e2h il\u00e2n edilmi\u015f olursa, \u015f\u00fcphe bulundu\u011fu i\u00e7in had cezas\u0131 d\u00fc\u015fer. Nitekim Allah’\u0131n Ras\u00fbl\u00fc; “G\u00fcc\u00fcn\u00fcz\u00fcn yetti\u011fi kadar , \u015f\u00fcphe bulununca had cezalar\u0131n\u0131 d\u00fc\u015f\u00fcr\u00fcn\u00fcz.” [30] buyurmu\u015ftur.<\/p>\n

                Hanbel\u00eelere g\u00f6re ise gizli tutma tavsiyesi nik\u00e2h\u0131 ge\u00e7ersiz k\u0131lmaz. Evlili\u011fi veli, \u015fahitler ve e\u015fler gizlese de bu ge\u00e7erli olur, fakat b\u00f6yle bir gizleme mekruhtur. [31] Di\u011fer yandan \u0130bn Eb\u00ee Leyl\u00e2, Eb\u00fb Sevr ve Eb\u00fb Bekr el-Esamm’a g\u00f6re evlilikte \u015fahit bulundurmak \u015fart de\u011fildir. Evlilik akdi ise ge\u00e7erlili\u011fini s\u00fcrd\u00fcr\u00fcr. E\u015flerden birisi veya her ikisi i\u00e7in belli bir s\u00fcre i\u00e7inde, nik\u00e2h\u0131 feshetme hakk\u0131n\u0131 \u00f6ne s\u00fcrmek gibi.
