      Kocan\u0131n ev masraflar\u0131n\u0131 kar\u015f\u0131lamamas\u0131 durumunda kad\u0131n mahkemeye ba\u015fvurarak kendisine nafaka takdir ettirebilir. Bunun belirlenmesinde kar\u0131 kocan\u0131n m\u00e2l\u00ee ve sosyal durumlar\u0131 birlikte dikkate al\u0131n\u0131r. Yaln\u0131z kocan\u0131n durumu dikkate al\u0131n\u0131r, diyen fakihler de vard\u0131r. Kad\u0131n takdir edilen nafakay\u0131 gerekti\u011finde icra yoluyla al\u0131r. Nafakay\u0131 \u00f6demeyen koca hapisle zorlanabilir.         Bununla birlikte kad\u0131n, kendisine ait gelirleri aile harcamalar\u0131na kar\u0131\u015ft\u0131rmayarak tasarruf da edebilir. Bunlar\u0131 karz (\u00f6d\u00fcn\u00e7) olarak kocas\u0131na kulland\u0131rabilir. Kendisine ait parayla sat\u0131n al\u0131nan ta\u015f\u0131n\u0131r veya ta\u015f\u0131nmaz mallar\u0131n kendi m\u00fclkiyetinde kalmas\u0131n\u0131 isteyebilir. Kocas\u0131n\u0131n \u00f6l\u00fcm\u00fc veya bo\u015fanma durumunda, kendisine ait mal ve haklar\u0131n\u0131 ayr\u0131ca hesaplatt\u0131rarak, miras d\u0131\u015f\u0131 kalmas\u0131n\u0131 sa\u011flayabilir.<\/p>\n

        2) Kocan\u0131n haklar\u0131:<\/p>\n

        Kocan\u0131n kar\u0131s\u0131 \u00fczerinde miras d\u0131\u015f\u0131nda bir m\u00e2l\u00ee hakk\u0131 bulunmamaktad\u0131r. Hatta kad\u0131n, kendisine ait bir evi ikametine tahsis etmesi i\u00e7in kocas\u0131na kiraya verebilir. [62] Kar\u0131 kocan\u0131n birbirine kar\u015f\u0131 sevgi ve sayg\u0131 ile davranmas\u0131 kar\u015f\u0131l\u0131kl\u0131 hak ve bor\u00e7lardand\u0131r.<\/p>\n

        Evli e\u015fler aras\u0131nda, ev i\u00e7i, ev d\u0131\u015f\u0131 i\u015flerde bir g\u00f6rev b\u00f6l\u00fcm\u00fc eski \u00e7a\u011flardan beri her devirde olmu\u015ftur. Bu konuda e\u015flerin ruh ve fizik yap\u0131lar\u0131, soysal ve k\u00fclt\u00fcrel \u00e7evre belirleyici olmu\u015ftur. Hz. Peygamber\u2019in evin i\u00e7indeki i\u015fleri k\u0131z\u0131 F\u00e2t\u0131ma\u2019ya, d\u0131\u015far\u0131daki i\u015fleri ise damad\u0131 Hz. Ali\u2019ye \u00f6\u011f\u00fctlemesi bu konuda geleneksel g\u00f6rev b\u00f6l\u00fcm\u00fcn\u00fc \u0130sl\u00e2m\u2019\u0131n da onaylad\u0131\u011f\u0131 anlam\u0131na gelebilir. Buna g\u00f6re d\u0131\u015far\u0131da \u00e7al\u0131\u015fmayan bir kad\u0131n\u0131n evin i\u00e7indeki i\u015fleri makul ve mar\u00fbf \u00f6l\u00e7\u00fcler i\u00e7inde yapmas\u0131, \u201ciyi ge\u00e7im kurallar\u0131\u201d na uyma olarak kabul edilebilir.<\/p>\n

Hz. \u00d6mer, bunun h\u00fckm\u00fcn\u00fc Neb\u00ee (s.a.s)\u2019e sordu. Allah\u2019\u0131n el\u00e7isi \u015f\u00f6yle buyurdu: \u201cOna emret, e\u015fine d\u00f6ns\u00fcn, sonra temizleninceye kadar onu tutsun (terk etsin), sonra \u00e2det g\u00f6rs\u00fcn, sonra temizlensin. Bundan sonra isterse tutsun, dilerse cinsel ili\u015fkiye girmezden \u00f6nce bo\u015fas\u0131n. \u0130\u015fte, Allah\u2019\u0131n kad\u0131nlar\u0131 i\u00e7inde bo\u015fanmas\u0131n\u0131 emretti\u011fi iddet (Tal\u00e2k, 65\/1) budur.\u201d [69]\n

          Ancak Hz. \u00d6mer\u2019in halifeli\u011fi s\u0131ras\u0131nda, e\u015fini \u00fc\u00e7 talakla birden bo\u015famalar yayg\u0131nla\u015f\u0131nca, bir ceza olmak \u00fczere bu tasarrufun ge\u00e7erli say\u0131lmas\u0131 yoluna gidilmi\u015ftir. Abdullah \u0130bn Abbas (r.anh\u00fcm\u00e2)\u2019dan nakledildi\u011fine g\u00f6re, o \u015f\u00f6yle demi\u015ftir: \u201cAllah\u2019\u0131n Ras\u00fbl\u00fc ile Eb\u00fb Bekir d\u00f6neminde ve Hz. \u00d6mer\u2019in halifeli\u011finin ilk iki y\u0131l\u0131nda \u00fc\u00e7 bo\u015fama bir say\u0131l\u0131yordu. \u00d6mer, \u201c\u015e\u00fcphesiz insanlar kendilerine s\u00fcre verilen bir konuda acele ediyorlar. \u015eunu onlara ge\u00e7erli saysak, dedi ve onu kendilerine uygulad\u0131.\u201d (M\u00fcslim, Tal\u00e2k, 15). Bu rivayet, Hz. Peygamber d\u00f6neminde, bir s\u00f6zle yap\u0131lan \u00fc\u00e7 bo\u015faman\u0131n bir say\u0131ld\u0131\u011f\u0131n\u0131, Hz. Eb\u00fb Bekir devrinde ve \u00d6mer\u2019in halifeli\u011finin ilk iki y\u0131l\u0131nda da uygulaman\u0131n bu \u015fekilde s\u00fcrd\u00fc\u011f\u00fcn\u00fc g\u00f6stermektedir. Bu durum, konu hakk\u0131nda nesih cereyan etmedi\u011fini ve Hz. \u00d6mer\u2019in uygulamas\u0131n\u0131n bir maslahat ve bo\u015fama konusunda ortaya \u00e7\u0131kan yeni duruma bir \u00e7\u00f6z\u00fcm bulmaktan ibaret oldu\u011funu da g\u00f6stermektedir.<\/p>\n

          Di\u011fer yandan evlili\u011fi sona erdiren \u201cz\u0131har\u201d, [70] \u201cil\u00e2\u201d, [71] hakeme ba\u015fvurma yoluyla bo\u015fanma,[72] gibi y\u00f6ntemler de vard\u0131r. G\u00fcn\u00fcm\u00fcz mahkeme yoluyla bo\u015fanmay\u0131 e\u015flerin resm\u00ee nik\u00e2h s\u0131ras\u0131nda ald\u0131klar\u0131 bir bo\u015fama yetkisini kullanma olarak de\u011ferlendirmek m\u00fcmk\u00fcnd\u00fcr.           Evli bir erkek, vekil arac\u0131l\u0131\u011f\u0131 ile bo\u015fanabilece\u011fi gibi, bu yetkiyi kendi e\u015fine de verebilir. Buna \u201ctefv\u00eez\u201d denir. S\u00fcrekli olarak verilince, art\u0131k kocan\u0131n bundan d\u00f6nmesi ge\u00e7erli olmaz. Bunun delili yukar\u0131daki ayet ve ona dayal\u0131 s\u00fcnnettir.<\/p>\n

          Hz. Ai\u015fe \u015f\u00f6yle demi\u015ftir: \u201cYukar\u0131daki ayetler inince, Allah\u2019\u0131n Ras\u00fbl\u2019\u00fc, benimle ba\u015flad\u0131, dedi ki: Sana bir \u015fey s\u00f6yleyece\u011fim, fakat ana- babanla g\u00f6r\u00fc\u015f\u00fcp, izin almad\u0131k\u00e7a, cevap vermede acele etme!\u201d Ai\u015fe dedi ki: O, babam\u0131n bana ayr\u0131lma konusunda izin vermeyece\u011fini biliyordu. Allah\u2019\u0131n Rasul\u2019\u00fc, bundan sonra Ahz\u00e2b, 33\/28, 29 ncu ayetlerini okudu. Ben dedim ki: Hangi konuda, ebeveynimden izin isteyeyim? \u015e\u00fcphesiz ben, Allah\u2019\u0131, Ras\u00fbl\u2019\u00fcn\u00fc ve ahiret yurdunu istiyorum. Sonra, Neb\u00ee (s.a.s)\u2019in \u00f6b\u00fcr e\u015fleri de benim yapt\u0131\u011f\u0131m\u0131n benzerini yapt\u0131lar.\u201d [76] Ba\u015fka bir rivayette, Hz. Ai\u015fe, \u201cBu se\u00e7me, bizim aleyhimize bir sonu\u00e7 do\u011furmad\u0131.\u201d Bir di\u011fer rivayette: \u201cAllah\u2019\u0131n Ras\u00fbl\u00fc bunu bir bo\u015fama olarak saymad\u0131.\u201d demi\u015ftir. [77] Buna g\u00f6re, \u0130sl\u00e2m hukukunda, bo\u015fanma yetkisi konusunda erkekle kad\u0131n\u0131n \u201ctefv\u00eez-i talak\u201d m\u00fcessesesi i\u015fletilerek e\u015fit haklara sahip k\u0131l\u0131nmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n

          1917 tarihli Osmanl\u0131 Devleti Hukuk-\u0131 Aile Kararnamesi 4. Maddede, \u201cNik\u00e2h ehliyetine sahip olmak i\u00e7in evlenecek erke\u011fin 18, kad\u0131n\u0131n 17 ya\u015f\u0131n\u0131 ikmal etmi\u015f olmas\u0131 \u015fartt\u0131r.\u201d denilmi\u015f ve 37. Maddede resmi nik\u00e2h prosed\u00fcr\u00fc \u015f\u00f6yle belirlenmi\u015ftir: \u201cAkit s\u0131ras\u0131nda, evlenecek erkek veya kad\u0131ndan birinin ikametg\u00e2h\u0131 bulunun kaza h\u00e2kimi veya n\u00e2ibi haz\u0131r bulunup nik\u00e2h akdini tanzim ve tescil eder.\u201d<\/p>\n

          G\u00fcn\u00fcm\u00fcz uygulamas\u0131nda resmi nik\u00e2htan sonra yap\u0131lan dini nik\u00e2h, resmi nik\u00e2h\u0131n onaylanmas\u0131 ve dini esaslara da uygunlu\u011funu onaylama niteli\u011findedir. Resmi nik\u00e2hla, e\u015fler bu nik\u00e2h\u0131n sona erdirilme \u015fekli konusunda da anla\u015fm\u0131\u015f say\u0131lmaktad\u0131r. Buna g\u00f6re resmi evli olan e\u015fler bu evlili\u011fi mahkeme yani hakem \u00f6n\u00fcnde sona erdirme konusunda e\u015fit haklara sahip olmaktad\u0131rlar. Bu da kad\u0131na bir bo\u015fama (tefv\u00eez-i talak) hakk\u0131 vermekten ba\u015fka bir \u015fey de\u011fildir. Bo\u015fama konusunda vek\u00e2lette sonradan azil yoluyla ruc\u00fb etmek m\u00fcmk\u00fcn oldu\u011fu halde, tefv\u00eez s\u00fcre zikredilmeden verildi\u011fi zaman, evlilik bo\u015fanma veya \u00f6l\u00fcmle sona erinceye kadar devam eder. Bu \u00f6zelli\u011fi ile vek\u00e2let ve tefviz birbirinden farkl\u0131 tasarruflard\u0131r.<\/p>\n

          Hz. Peygamber\u2019in yukar\u0131daki ayetlerle verdi\u011fi bo\u015fanma hakk\u0131 ise, s\u0131n\u0131rl\u0131 bir s\u00fcreyi kapsam\u0131\u015f ve e\u015fler evlili\u011fe devam etme iradesini bildirince bo\u015fanma meydana gelmemi\u015ftir. Hz. Ai\u015fe\u2019nin yukar\u0131da verdi\u011fimiz a\u00e7\u0131klamas\u0131ndan bu durum a\u00e7\u0131k\u00e7a anla\u015f\u0131lmaktad\u0131r.<\/p>\n

          Sonu\u00e7 olarak, bo\u015fanan kad\u0131n bo\u015fama hangi \u00e7e\u015fitten olursa olsun, \u00fc\u00e7 hay\u0131z ve temizlenme s\u00fcresince iddet bekler. [78] Bu iddet s\u00fcresince de kocan\u0131n nafaka y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc devam eder. Kad\u0131n gebe ise, bu y\u00fck\u00fcml\u00fcl\u00fck do\u011fuma kadar s\u00fcrer. Ancak \u015e\u00e2fi\u00ee, M\u00e2lik\u00ee ve Hanbel\u00ee mezheplerine g\u00f6re \u00fc\u00e7 kez bo\u015fanan kad\u0131na iddet s\u00fcresince yaln\u0131z mesken temin edilir, giyim, yiyecek ve benzerleri gerekmez.<\/p>\n

          Di\u011fer yandan evlilik s\u00fcresince edinilen mal varl\u0131\u011f\u0131n\u0131n kazan\u0131lmas\u0131nda kad\u0131n\u0131n da \u00e7al\u0131\u015fmas\u0131 ve katk\u0131s\u0131 dikkate al\u0131narak bir mal ay\u0131r\u0131m\u0131 yoluna gidilmesi gerekir. Bat\u0131 toplumlar\u0131nda e\u015flerin katk\u0131s\u0131n\u0131n birbirine yak\u0131n oldu\u011fu dikkate al\u0131narak, evlilik s\u00fcresince elde edilen mal varl\u0131\u011f\u0131n\u0131n ikiye b\u00f6l\u00fcnmesi ilkesi uygulanmaktad\u0131r. Son d\u00f6nemde T\u00fcrkiye de bu ilkeyi uygulamaktad\u0131r. Kur\u2019an-\u0131 Kerim\u2019de aile konusunda s\u0131k\u00e7a \u201cma\u2019r\u00fbf\u201d ilkesine vurgu yap\u0131lmas\u0131 dikkat \u00e7ekicidir. Ayette:<\/p>\n
